Third Circuit Hears Appeal Against DaimlerChrysler

Law360, New York (September 27, 2006, 12:00 AM ET) -- Billionaire investor Kirk Kerkorian picked up where he left off on Tuesday, arguing an appeal in his case against car company DaimlerChrysler over its 1998 merger.

Kerkorian alleges in his appeal that the United States District Court for the District of Delaware erred in tossing his suit in 2005.

Kerkorian was pursuing claims for more than $1.3 billion, alleging that Daimler-Benz orchestrated the merger with Chrysler and subsequently blocked him from gaining an acquisition premium by calling the deal a merger of equals rather than a...
