Law360, New York (September 22, 2009, 4:28 PM ET) -- A federal appeals court has denied outsourcing firm eTelecare Global Solutions-US Inc.'s challenge of a trial court's refusal to compel arbitration in its dispute with a former employee, citing the company's failure to produce the full arbitration agreement.
Although James Dreyfuss did not deny signing the agreement, eTelecare failed to demonstrate the terms of the contract, according to a summary order issued Sept. 21 in the U.S. Court of Appeals for the Second Circuit.
