Law360, New York (May 24, 2010, 5:08 PM ET) -- The U.S. Supreme Court on Monday asked the solicitor general to weigh in on whether generic-drug makers can be held liable for providing allegedly inadequate warnings on product labels, a scenario industry advocates say could undermine the entire process for generic-drug approval.
The court issued an order requesting the legal office representing the U.S. to submit briefings in the case, brought by patient Gladys Mensing against Pliva Inc., Teva Pharmaceuticals USA Inc., UDL Laboratories Inc. and others.
