Telecom Co. Close To Antitrust Breach: EU High Court

Law360, New York (February 17, 2011, 5:47 PM ET) -- A dominant wholesale broadband Internet provider that charges retail customers less for service than it costs the company to provide that access may run afoul of the European Union's ban on abuse of dominance, the bloc's highest court ruled Thursday.

In a preliminary ruling in a dispute between Sweden's competition watchdog and major Swedish telecom provider TeliaSonera AB, the European Court of Justice said that the so-called margin squeeze violates EU antitrust law under certain conditions.
