Law360, New York (April 27, 2011, 9:52 PM ET) -- Abbott Laboratories on Wednesday challenged an Illinois federal judge's ruling that a class of sales representatives are not exempt from federally mandated premium overtime pay rates because they don't actually make sales, filing an appeal in the Seventh Circuit.
The appeal came a day after U.S. District Judge Ruben Castillo issued final judgment in favor of the 57 plaintiffs who claimed $3.5 million in losses, but delayed determining the amount of damages, attorneys' fees and costs until the parties had exhausted their right to appeal. An...
