Law360, New York (May 11, 2012, 6:19 PM ET) -- The U.S. government on Friday asked the Federal Circuit to overturn a lower court's $6.8 million breach of contract award to Scott Timber Co., saying the trial judge misapplied contract law in deciding the case and awarded the damages improperly.
Assistant Attorney General Ellen Mary Lynch first attacked U.S. Court of Federal Claims Judge Charles F. Lettow’s 2009 opinion that the government was liable for suspending and breaching three 1999 U.S. Forest Service timber contracts won by Scott for forest areas in Oregon.
