Law360, New York (June 13, 2008, 12:00 AM ET) -- In a boost to Kia Motors America Corp., a Florida state appeals court has ruled that a class of consumers who bought Sephia model vehicles with allegedly defective brake systems should not have been certified.
A three-judge panel of the Third District Court of Appeal of Florida said Wednesday that the Circuit Court for Miami-Dade County had abused its discretion by certifying the class because the plaintiffs hadn't satisfied the relevant requirements under Florida civil procedure rules.
