Circuit Denies Alcatel Retirees' Injunction Request

Law360, New York (June 24, 2008, 12:00 AM ET) -- An appellate court has upheld a Texas judge's ruling that Alcatel-Lucent retirees are not entitled to an injunction that would stop the technology company from cutting contributions to retiree health benefit plans.

The U.S. Court of Appeals for the Fifth Circuit ruled on Friday that a purported class action against an Alcatel-Lucent predecessor was unlikely to succeed, that the contribution cuts would not cause irreparable harm to retirees and that too much damage would be done to the company if an injunction were granted.
