Law360, New York (August 01, 2008, 12:00 AM ET) -- The U.S. Court of Appeals for the Seventh Circuit has affirmed a district court's ruling that a case involving 144 plaintiffs suing companies over damages from chemicals allegedly escaping from a wood-processing plant belongs in U.S. court.
The appeals court agreed on Friday with a decision by the U.S. District Court, Northern District of Illinois, Eastern Division, that the plaintiffs constituted a “mass action” under the Class Action Fairness Act.
