Jury Trial For Inequitable Conduct Not Mandatory

Law360, New York (June 27, 2006, 12:00 AM ET) -- A jury trial is not required in a patent case alleging inequitable conduct, the Federal Circuit ruled on Monday, upholding precedent and the lower court’s ruling in a case over a printing process patent.

“A judge retains the discretion to conduct a bench trial on the equitable issue of unenforceability in the same case where invalidity is to be tried to a jury,” Judge Randall Rader said in the decision.
