Appeals Court OKs Animalfeeds Class Effort

Law360, New York (November 04, 2008, 12:00 AM ET) -- An appeals court has ruled that an arbitration board can allow Animalfeeds International Corp. to pursue class relief against a group of shipping companies for allegedly conspiring to restrict competition in the shipping industry using arbitration.

Judge Robert D. Sack of the U.S. Court of Appeals for the Second Circuit ruled Tuesday that the U.S. District Court for the Southern District of New York erred when it vacated an arbitration award that allowed Animalfeeds to seek to certify a class against the companies.
