Law360, New York (April 03, 2009, 12:00 AM ET) -- The U.S. Federal Energy Regulatory Commission has challenged a circuit court decision that says the commission cannot overrule state authorities on the siting of power transmission lines, asking for an en banc rehearing of the case.
FERC filed a petition for an en banc hearing on Thursday, asking the U.S. Court of Appeals for the Fourth Circuit to give it site transmission projects under the Energy Policy Act of 2005, even when the projects have already been nixed by state governments.
