High Court Agrees To Review SOX Challenge

Law360, New York (May 18, 2009, 12:00 AM EDT) -- Opening up yet another front in a long-running battle over the Sarbanes-Oxley Act, the U.S. Supreme Court has agreed to take up a case challenging the constitutionality of the Public Company Accounting Oversight Board established by the 2002 law.

The Free Enterprise Fund, a libertarian lobbyist group, and Beckstead & Watts LLP, a Nevada accounting firm, have together continually challenged the constitutionality of the PCAOB, although they have lost every battle in the fight to date.
