FEMA Wins Dismissal Bid In River Levee Suit

Law360, New York (July 23, 2009, 11:07 PM EDT) -- A federal judge on Thursday dismissed an environmental group’s suit accusing the Federal Emergency Management Agency of relaxing its insurance-related floodplain regulations for an urban levee project because the complaint lacks subject matter jurisdiction.

Magistrate Judge David D. Noce tossed the allegations of the Great Rivers Habitat Alliance and the Adolphus A. Busch Revocable Living Trust in the U.S. District Court for the Eastern District of Missouri, granting FEMA and the U.S. Department of Homeland Security’s motion to dismiss the case.
