Walgreen Hits Cephalon Over Provigil Generic Deals

Law360, New York (August 31, 2009, 7:04 PM EDT) -- Walgreen Co., Safeway Inc. and three others have become the latest retailers to accuse Cephalon Inc. of striking illegal deals with generic-drug makers to keep a copycat version of narcolepsy drug Provigil off the market.

Walgreen, Safeway, The Kroger Co., American Sales Co. Inc. and Heb Grocery Company LP filed their complaint Monday in the U.S. District Court for the Eastern District of Pennsylvania.

In addition to Cephalon and Teva Pharmaceutical Industries Ltd., the complaint names Barr Pharmaceuticals Inc., Mylan Pharmaceuticals Inc. and Ranbaxy Laboratories Ltd....
