Federal Circuit Upholds Genentech Victory Vs. Chiron

Law360, New York (April 07, 2004, 12:00 AM ET) -- The U.S. Court of Appeals for the Federal Circuit court has upheld Genentech's legal victory in a $1 billion patent battle with biotechnology rival Chiron.

The federal appeals court agreed with the lower court that Chiron had failed to disclose the subject matter of one of the patents for Herceptin, a humanized antibody useful for the long-term treatment of breast cancer.
