General Star Excess Policy Spat Revived

Law360, New York (November 05, 2009, 6:31 PM ET) -- A federal appeals court has vacated a judgment finding that General Star National Insurance Co. was bound by the terms of an excess insurance policy it had issued related to the settlement of a state court personal injury lawsuit.

The U.S. Court of Appeals for the Second Circuit held Thursday that a lower court wrongly found that the judgment established legal liability against Universal Fabricators Inc., a contractor doing work at the New York City Passenger Ship Terminal, where the injury at issue occurred.
