NASCAR Takes Checkered Flag In Antitrust Case

Law360, New York (December 11, 2009, 5:59 PM ET) -- A federal appeals court has unanimously affirmed that the National Association of Stock Car Auto Racing Inc. can choose where it stages its races, dealing an upset to a Kentucky race track that argued NASCAR was illegally monopolizing the high-end auto racing market.

The U.S. Court of Appeals for the Sixth Circuit on Friday unanimously affirmed a lower court decision against Kentucky Speedway LLC, tossing testimony of the company's two market experts, and with it, the entire antitrust case.
