Court Rejects Moves To Toss Fractus Antenna Suit

Law360, New York (January 08, 2010, 3:43 PM ET) -- Adopting several recommendations by a magistrate judge, a federal court has refused to dismiss Fractus SA’s patent infringement claims against Sharp Corp. and Sanyo Electric Co. Ltd. over internal antenna technology.

Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas on Thursday agreed with a magistrate judge’s report that Sharp’s bid to toss the case for failure to state a claim and Sanyo’s motion to throw out the action for lack of personal jurisdiction should be denied.
