Broadcom Moves To Dismiss Emulex Antitrust Suit

Law360, New York (February 08, 2010, 2:17 PM ET) -- Broadcom Corp. has asked a judge to toss an antitrust lawsuit brought by Emulex Corp. alleging that Broadcom made misleading and disparaging statements about Emulex during a tender offer in an effort to monopolize the market for an Ethernet controller.

In two separate motions to dismiss filed Thursday in the U.S. District Court for the Central District of California, Broadcom asked the court to reject Emulex’s claims that Broadcom’s public statements constituted defamation and toss the entire first amended complaint.
