Brokerage Firm FLSA Spat Heads To Arbitration

Law360, New York (February 08, 2010, 12:52 PM ET) -- A federal judge has ruled that a putative Fair Labor Standards Act collective action accusing commodity broker Blue Fish Commodities Inc. of failing to pay overtime should be decided in arbitration.

Judge Victor Marrero of the U.S. District Court for the Southern District of New York issued the ruling Thursday, rejecting the arguments of Anthony Arrigo, who worked as an account executive, that the arbitration clause in his employment agreement did not apply to his claims.
