Sanctions, Damages Reversed In Software Patent Suit

Law360, New York (February 08, 2010, 3:12 PM ET) -- A federal appeals court has reversed sanctions against attorneys for ResQNet.com Inc. stemming from the alleged bad-faith inclusion of certain patents in its infringement suit over software technology, while remanding the damages calculation against defendant Lansa Inc.

In a split opinion Friday in the U.S. Court of Appeals for the Federal Circuit, a three-judge panel said a district court relied on unreasonable logic in imposing a $100,000 penalty under Rule 11 on attorneys for ResQNet from Kaplan Gilman & Pergament LLP.
