North Face Trademark Suit V. South Butt To Continue

Law360, New York (February 12, 2010, 1:47 PM ET) -- A federal judge has denied a request by The South Butt LLC and its founder to dismiss trademark infringement and dilution allegations brought by The North Face Apparel Corp.

Judge Rodney Sippel of the U.S. District Court for the Eastern District of Missouri on Tuesday denied the motion to dismiss, ruling that the marks of the new brand were not so dissimilar that it was implausible that they would create confusion.

Judge Sippel also chastised the defendants for filing a motion that bordered on frivolous....
