Perrigo ANDA Doesn't Infringe Mucinex Patent: Judge

Law360, New York (February 12, 2010, 1:02 PM ET) -- A federal judge has handed Perrigo Co. victory in a suit brought by a Reckitt Benckiser Group PLC subsidiary, ruling that the generic-drug manufacturer did not infringe a patent for the expectorant Mucinex through its attempt to introduce its own version of the drug.

Judge Gordon J. Quist of the U.S. District Court for the Western District of Michigan on Thursday agreed with Perrigo that no reasonable jury would find that the company had infringed the claims of the Mucinex patent as construed by the court,...
