Prudential Coverage Denials Breached ERISA: Suit

Law360, New York (February 19, 2010, 4:49 PM ET) -- Prudential Insurance Company of America policyholders have lodged a putative Employee Retirement Income Security Act class action against the insurer for allegedly subjecting them to an unfair long-term disability benefits claims denial process.

Four individuals filed a complaint Thursday in the U.S. District Court for the Eastern District of New York that accuses the company of breaching its fiduciary duty by failing to give a “full and fair review” of coverage denials during the voluntary level of the appeals process.
