Fraud Suit Against Walgreens Dismissed Again

Law360, New York (February 19, 2010, 3:03 PM ET) -- A federal judge has dismissed for a second time a suit accusing Walgreen Co. of scheming to overcharge third-party payors by improperly filling prescriptions for two generic drugs.

Judge Virginia M. Kendall of the U.S. District Court for the Northern District of Illinois on Thursday granted Walgreens' motion to dismiss all of plaintiff Pirelli Armstrong Tire Corp. Retiree Medical Benefits Trust's claims with prejudice, ruling that the amended complaint did little to satisfy the deficiencies in the first complaint, which she dismissed without prejudice in September....
