Lawn Mower Maker Can't Mow Down Age Bias Action

Law360, New York (March 11, 2010, 3:58 PM ET) -- An age discrimination class action brought by an ex-employee of lawn mower manufacturer MTD Products Inc. can move forward now that a federal judge has denied the company's bid to throw out the suit.

Judge Joy Flowers Conti of the U.S. District Court for the Western District of Pennsylvania denied MTD's motion for summary judgment on Tuesday, agreeing with William Bogacz, the plaintiff, that a release he signed that supposedly waived his right to sue is invalid.
