Allstate Owes Wyeth Defense For Ativan Suits: Judge

Law360, New York (March 31, 2010, 6:23 PM EDT) -- A magistrate judge has determined that Allstate Insurance Co. is obligated to pay defense costs for foreign product liability suits over the anxiety drug Ativan brought against Pfizer Inc. unit Wyeth Inc. during the 1980s and 1990s.

Magistrate Judge Henry Pitman of the U.S. District Court for the Southern District of New York on Wednesday ruled in favor of Wyeth on the parties' cross-motions for summary judgment, determining that Allstate's excess policies extend to coverage of defense costs for the Ativan cases.
