Pfizer, Wyeth Antitrust Complaint Nixed For 3rd Time

Law360, New York (April 19, 2010, 5:16 PM EDT) -- A federal judge has thrown out an antitrust suit brought by a group of pharmacies over Pfizer Inc.'s $68 billion merger with Wyeth, holding that the plaintiffs failed to sufficiently allege the existence of a cognizable product market.

Judge Maxine M. Chesney of the U.S. District Court for the Northern District of California signed off on an order granting Pfizer and Wyeth's motion to dismiss the defendants' second amended complaint on Friday.
