Law360, New York (April 20, 2010, 2:22 PM ET) -- A magistrate judge has conditionally certified a collective Fair Labor Standards Act action alleging Mortgage Source LLC improperly denies its loan officers minimum wage and overtime pay.
Magistrate Judge A. Kathleen Tomlinson of the U.S. District Court for the Eastern District of New York said in order filed April 14 that the overtime claim in the suit brought by Desiree Vaughn should be conditionally certified. The parties, she said, already agreed to certification of Vaughn's minimum wage claim.
