Regulating Info Exchange Under EU Antitrust Rules

Law360, New York (July 9, 2010, 2:58 PM EDT) -- On May 4, 2010, the European Commission published a package of proposals to overhaul European Union (EU) competition law, which includes revised guidelines on the assessment of such horizontal co-operation agreements under Article 101 of the Treaty on the Functioning of the European Union (TFEU; former Art. 81 EC-Treaty) (“Draft Guidelines”).

In the Draft Guidelines, the commission for the first time sets out general guidance for assessing information exchanges/sharing among competitors. The final guidelines are expected to be issued by the end of this year....
