Judge Won't Allow Split H&R Block FLSA Claims

Law360, New York (July 27, 2010, 4:12 PM EDT) -- A judge has thrown out a group of tax professionals' putative class action alleging H&R Block Inc. refused to pay employees for mandatory training sessions and forced tax preparers to work off the clock, ruling that the action violates rules against claim-splitting due to a pending, earlier-filed suit.

The case is duplicative of the claims in the earlier-filed suit and should be dismissed, not consolidated as the plaintiffs had requested, Judge James Lawrence King ruled in the U.S. District Court for the Southern District of Florida...
