Airgas Suit Against Cravath Over Buyout Bid Survives

Law360, New York (August 03, 2010, 6:54 PM ET) -- A federal judge on Tuesday denied Cravath Swaine & Moore LLP's motion to dismiss a breach of fiduciary duty suit brought by Airgas Inc., finding that the claims over the firm's representation of Airgas takeover suitor Air Products & Chemicals Inc. merit further airing in court.

Judge Eduardo C. Robreno of the U.S. District Court for the Eastern District of Pennsylvania found that Airgas had sufficiently pled its breach of fiduciary duty claims and arguments for damages and disgorgement against Cravath.
