An Update On Foreign Investment Review In Canada

Law360, New York (September 1, 2010, 4:11 PM EDT) -- Foreign investment in Canada is governed principally by the Investment Canada Act. The ICA requires foreign acquirors of non-Canadian businesses to obtain Canadian government approval for their investments when certain thresholds are exceeded. Foreign investors typically provide the government with "undertakings" in order to secure these approvals. These undertakings generally include commitments to maintain employment levels in Canada, invest in the Canadian business and ensure that Canadians stay involved in the management of the Canadian business.
