Kan. Citizens Lose Bid To Bar High Court Nomination

Law360, New York (September 15, 2010, 1:30 PM EDT) -- A federal judge has refused to enjoin the Kansas Supreme Court Nominating Commission from acting to fill a vacancy on the state's highest court, striking a blow to four citizens waging a constitutional fight over the judicial selection process.

Judge Monti L. Belot of the U.S. District Court for the District of Kansas denied the request for a preliminary injunction and restraining order Tuesday in the case, which was filed by a prominent conservative lawyer who also fought judicial election rules in Kentucky.
