3rd Time Not The Charm For Cert. In Insulation Action

Law360, New York (September 24, 2010, 5:52 PM ET) -- A federal judge has for a third time declined to certify a class of California homeowners who allege that insulation manufactured by U.S. Greenfiber LLC caused water damage and dangerous mold growth.

The main impediment to class certification is that any common issues raised by the plaintiffs under California’s “Right of Repair Act” do not predominate over individual ones, according to Judge A. Howard Matz of the U.S. District Court for the Central District of California, who rejected the class certification motion Wednesday.
