FedEx Hit With False Marking Suit Over Engine Kits

Law360, New York (October 29, 2010, 4:12 PM EDT) -- FedEx Corp. has been accused of deceiving the public by marking noise-reducing kits for aircraft engines with an expired patent.

Continuing a campaign against false patent marking, Main Hastings LLC filed suit Thursday in the U.S. District Court for the Eastern District of Texas, claiming FedEx unlawfully labels a line of airplane engine-muffling components with a patent that expired about a year ago.

Specifically, FedEx continues to mark its Hushkit Stage 3 Kit with U.S. Patent Number 5,127,602, titled “Noise reduction kit for jet turbine engines,”...
