BASF Hit With False Marking Suit Over Herbicides

Law360, New York (January 28, 2011, 6:28 PM EST) -- German chemical giant BASF SE has been accused of marking several herbicides with a patent that expired in 2006.

Texas IP Research LLC filed a complaint in the U.S. District Court for the Eastern District of Texas on Thursday, saying that BASF and its U.S. subsidiary, New Jersey-based BASF Corp., intended to deceive the public and limit competition by marking five herbicides with the expired patent.

The patent-in-suit, U.S. Patent Number 4,798,619, is a chemical compound used in herbicides. BASF filed for the patent in April...
