Law360, New York (March 09, 2011, 7:04 PM ET) -- A Louisiana federal judge on Wednesday kept alive a putative class action over insect parts found in Abbott Laboratories Inc. baby formula, despite Abbott's arguments that the case should be tossed.
Judge Sarah S. Vance of the U.S. District Court for the Eastern District of Louisiana denied Abbott's motion to dismiss the case, which was brought by a lawyer who fed his son a brand of formula that was later recalled because it may have been contaminated with beetle parts.
