4th Circ. Revives Kevlar Antitrust Claim V. DuPont

Law360, New York (March 11, 2011, 6:33 PM EST) -- The Fourth Circuit on Friday revived Kolon Industries Inc.'s antitrust counterclaims against DuPont Co. in a suit alleging Kolon used trade secrets related to DuPont's body armor component Kevlar that a former DuPont employee had stolen.

In an opinion penned by Judge James A. Wynn Jr., the U.S. Court of Appeals for the Fourth Circuit ruled that the lower court had wrongly dismissed Kolon's claim for failure to allege a proper geographic market.
