Fed. Circ. Overturns Customs' Wall Panel Duties

Law360, New York (March 31, 2011, 4:15 PM EDT) -- The Federal Circuit nixed duties Thursday imposed by U.S. Customs and Border Protection on StoreWall LLC's Taiwan-imported wall panels and hanging tabs, making a precedential ruling that Customs improperly classified the products and imposed inappropriate duties.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit ruled that the wall panels and “HangUp” locator tabs were parts of furniture, which fell under a different subheading than the one Customs applied.
