Dukes Won’t Bar Cert. In FDNY Bias Suit: Judge

Law360, New York (July 11, 2011, 7:30 PM ET) -- A federal judge on Friday rejected New York's attempt to use the U.S. Supreme Court’s recent Dukes ruling to decertify a subclass of firefighters in a suit over the city’s alleged discriminatory policies against minority firefighter applicants.

The current case is the remedial phase of a successful suit against the city brought by the U.S. Department of Justice and intervenor Vulcan Society Inc., an association of black firefighters. The plaintiffs alleged that discriminatory entrance exams cost more than 1,000 black and Hispanic firefighter applicants jobs....
