9th Circ. Backs Reduction Of Damages Against Allstate

Law360, New York (August 19, 2011, 7:49 PM EDT) -- The Ninth Circuit on Thursday backed a lower court's decision cutting Metropolitan Business Management Inc.'s $3 million punitive damages award by $1 million and denying the company attorneys' fees in its successful breach of contract lawsuit against Allstate Insurance Co.

While preserving findings in favor of MBM, a three-judge panel held that the district court didn't err in reducing its punitive damages award after determining on reconsideration that the evidence of Allstate repeating the conduct at issue was weak.
