Law360, New York (June 14, 2007, 12:00 AM EDT) -- Far from being a dint in the armory of tobacco giants defending the marketing of “light” cigarettes, the recent U.S. Supreme Court ruling banning the removal of smoker lawsuits to federal courts is a victory of sorts. Or so says Philip Morris.

Call it cockeyed optimism if you will, but don't call the U.S. Supreme Court's recent dismissal of an industry defense strategy an all-out defeat, says the cigarette maker's in-house lawyers. Sometimes a cigar is just a cigar, but sometimes it isn't.
