Condom Maker's USAID Suit Premature, Judge Says

Law360, New York (October 18, 2011, 6:42 PM EDT) -- The U.S. Court of Federal Claims on Tuesday tossed breach of contract claims filed against the U.S. Agency for International Development by a condom manufacturer, finding that the company jumped the gun by suing the agency before its contracting decision was final.

Alatech Healthcare LLC had accused USAID of unfairly rejecting more than 20 million condoms because of black particles found on the condoms.
