Mediation Board Tries To Boot American Airlines Union Suit

Law360, New York (May 17, 2012, 4:34 PM ET) -- The National Mediation Board on Thursday moved to toss a case brought by bankrupt American Airlines Inc. that seeks to block an election in a nearly 10,000-employee union, arguing the court lacks subject matter jurisdiction over the board.

American sued the NMB, a federal government body, on May 2 in a Texas federal court, arguing that a new law requires 50 percent of employees to show interest in unionizing before a vote is scheduled, as opposed to the 35-percent standard used by the board prior, according...
