AMO Wins Summary Judgment In LASIK Patent Case

Law360, New York (September 25, 2007, 12:00 AM EDT) -- A court ruled Tuesday that a doctor who says that she invented the technology behind the popular LASIK vision correction surgery had waited too long to sue the current holders of patents on the technology for her rights as inventor.

Judge Denise Cote, of the Southern District of New York, agreed with the defendants in the case that the doctor, Olivia Serdarevic, was estopped by the doctrine of laches from bringing her action, in an order granting the defendants' motion for summary judgment.
