Doc-For-Hire Can't Sue For Discrimination, 8th Circ. Says

Law360, New York (October 31, 2012, 5:19 PM EDT) -- An emergency room doctor hired to fill in at an Iowa hospital is an independent contractor and can’t sue the physician-owned contractor that hired her for discrimination under federal and state civil rights laws, the Eighth Circuit said Wednesday.

A three-judge panel upheld a lower court decision dismissing the suit by Dr. Pooneh Hendi Glascock against Linn County Emergency Medicine PC on the grounds that independent contractors aren’t covered under Title VII of the Civil Rights Act or under the Iowa Civil Rights Act.
