Judge Denies Fee Award To Pfizer In Celebrex Case

Law360, New York (December 5, 2007, 12:00 AM EST) -- Months after winning a challenge to its three U.S. patents covering painkiller Celebrex, Pfizer will not be able to reach into Israeli generics maker Teva Pharmaceuticals’ pockets to pay for legal fees.

Judge Garrett E. Brown Jr. determined Wednesday in the U.S. District Court for the District of New Jersey that Pfizer failed to show that Teva engaged in litigation misconduct before and during the trial or that it acted in bad faith by raising defenses in its paragraph IV certification.
