Litgo Liable For Most Of NJ Site Cleanup, 3rd Circ. Finds

Law360, Los Angeles (August 6, 2013, 6:21 PM EDT) -- The Third Circuit said Tuesday that Litgo New Jersey Inc. was responsible for most of the cleanup costs at a polluted New Jersey military site, ruling that the federal government, which owned equipment used at the site, didn't cause the hazardous waste.

The appellate court affirmed a lower court's finding, saying there was no suggestion that the U.S.-owned equipment was attached to vapor degreaser tanks that disposed of waste.
